Black Flag Funding is a commercial funding broker. We are not a lender, bank, or financial institution. We connect business owners and their representatives with third-party lenders and funding providers. We do not make credit decisions, guarantee funding approvals, or control the terms offered by any lender or funding source.

Submitting an inquiry through the Site does not constitute an application for credit and does not create any obligation on the part of Black Flag Funding or any lender to extend funding.

3. Eligibility

By using the Site and submitting an inquiry, you represent that:

• You are at least 18 years of age.
• You are a business owner, authorized representative of a business entity, or a licensed broker submitting on behalf of a client.
• The information you provide is accurate, complete, and not misleading.
• You have the authority to share any business or personal information submitted through the Site.

4. Broker Partnerships

Individuals who inquire about or engage in a broker or referral partner relationship with Black Flag Funding do so subject to any additional terms communicated during onboarding. Broker partners are independent and are not employees, agents, or representatives of Black Flag Funding unless expressly stated in a written agreement.

5. Information Accuracy

The content on this Site is provided for general informational purposes only. Funding products, eligibility criteria, rates, and timelines are subject to change without notice. Nothing on this Site constitutes financial, legal, or tax advice. You should consult qualified professionals before making funding decisions.

6. No Guarantee of Funding

Submission of an inquiry does not guarantee that funding will be offered, approved, or funded. All funding is subject to underwriting review by third-party lenders. Terms, rates, and amounts vary by file, lender, and product type.

7. Third-Party Lenders and Services

Black Flag Funding works with a network of third-party lenders and funding providers. Your information may be shared with these parties in order to evaluate and process your inquiry. Black Flag Funding is not responsible for the actions, decisions, terms, or practices of any third-party lender or funding provider.

8. Intellectual Property

All content on the Site, including text, graphics, logos, and design, is the property of Black Flag Funding LLC or its content licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Black Flag Funding LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any funding outcome. Our total liability for any claim shall not exceed one hundred dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless Black Flag Funding LLC and its members, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your submission of inaccurate or fraudulent information, or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Salt Lake County, Utah.
